K <br />Attached is a model ordinance received from the N.C. <br />Association of County Commissioners concerning the <br />legislation, and a staff response. The proposed <br />amendment was found to be for the most part, <br />consistent with the provision found in the model <br />ordinance. <br />Staff does recommend that the draft presented at the <br />public hearing be revised to require that the <br />following statement be placed on all approved Site <br />Specific Development Plans, as recommended in the <br />model. <br />"Approval of this plan establishes a zoning <br />vested right under G.S. 153A- 344.1. Unless <br />terminated at an earlier date, the zoning right <br />shall be valid until " <br />(See italics in excerpt from Article 14.3 in proposed <br />amendment.) <br />The Planning Board considered the proposed amendment, <br />as revised, on September 15, 1991 and recommended <br />approval. <br />RECOMMENDATION: The Administration recommends approval of the proposed <br />amendment revised to include a statement on the <br />approved plan that a vested right has been <br />established. <br />
