9 <br />x <br />forth, hereby leases, subject to the conditions herein contained, <br />to County, and County accepts as tenant of Board of Education, the <br />following described real property located in Cheeks Township, <br />Orange County, North Carolina, and more particularly described as <br />follows: <br />Lot 112," containing 5.43 acres as shown on a survey plat <br />titled Property Surveyed For Efland- Cheeks Community Center <br />& Park, prepared August 28, 1991 by Callemyn Land Surveyors, <br />and recorded in Plat Book , at Page of the Orange <br />County Register of Deeds. <br />1. Term. This lease agreement shall commence on the 7th day <br />of October, 1991, and unless sooner terminated as herein provided <br />shall exist and continue for a term of fifty ( 50 ) years thereafter. <br />2. Rental. The rental for the use of said premises shall <br />be the sum of ONE DOLLAR ($1.00) per year, payable on or before <br />each anniversary date of this lease to the order of Board of <br />Education, and forwarded to the finance director of Board of <br />Education, at the address hereinafter set forth. <br />3. Acceptance and Use of Premises. County agrees to accept <br />the premises as they now exist with no obligation on the part of <br />Board of Education to make any improvements thereto, and agrees <br />during the term of this lease not to make any unlawful use of the <br />premises, and to use the premises only for public purposes <br />authorized by law. <br />4. Taxes. County agrees and covenants to reimburse Board <br />of Education for any ad valorem or property taxes, assessments, or <br />public charges on the real property leased, and on any improvements <br />located on said real property.
