N' <br />programs and ordinances? <br />Local governments can modify their originally approved local <br />programs after they have been approved by the EMC. These <br />changes, however, must at least meet the statewide minimum <br />standards for the classification, and must be approved by the <br />EMC. <br />• How are activities such as fishing, hunting and boating effected? <br />The adopted rules do not effect these activities. The rules <br />do require that local governments address water based <br />activities under a comprehensive nonpoint source management <br />plan in order to avoid potential risks from gas and oil from <br />boats and runoff from adjacent buildings, marinas and parking <br />areas. Some existing rules for recreation occurring on water <br />supply reservoirs are addressed by the Division of <br />Environmental Health. <br />• What effect does a supplemental classification have? <br />Supplemental classifications may already be assigned to <br />some water supply waters in your jurisdiction. These <br />supplemental classifications also carry narrative and /or <br />numeric water quality standards. These standards are to be <br />used in conjunction with the water supply protection <br />requirements, however the more stringent of the two is <br />applicable when there are overlapping requirements. It is <br />suggested that local ordinances be adopted so as to recognize <br />these overlaps where applicable. A summary of the <br />supplemental classifications is enclosed in this document. <br />• Can a proposed classification be changed before final adoption by <br />the EMC this December? <br />The DEM staff and EMC have made their best efforts in <br />determining the appropriate classification for each of the <br />approximately 200 surface water supply watersheds in the <br />state. The staff has used its best professional judgement in <br />assessing land use characteristics when this data was <br />available. In proposing a classification for each water sup- <br />ply, the highest classification a water supply qualifies for <br />has been proposed as per the intent of the EMC. The adopted <br />rules allow for a degree of flexibility for assigning the final <br />classification. Thus in some instances the staff allowed a <br />minor nonconforming activity such as a single domestic dis- <br />charge which might otherwise preclude a higher classification. <br />The statute requires the EMC to adopt the most appropriate <br />classification for each water supply.
