53 <br />• Agricultural Practices. The proposed modifications to the <br />rules outline the provisions that agricultural activities <br />must now meet through existing regulations. In addition it <br />is proposed that in WS -I watersheds and the critical areas <br />Of WS -II, WS -III and WS -IV watersheds a 10 foot buffer be <br />maintained around perennial waters and that BMPs be <br />required for animal operations greater than 100 animal <br />units. - Section .0104(q) <br />• Silvicultural Practices. Silvicultural activities are <br />currently required to implement water quality protection <br />measures through the Forest Practices Guidelines Related to <br />Water Quality. This existing requirements are clarified in <br />the proposed modifications. - Section .0104(u) <br />• Other Proposed Changes in Section .0104. Other additions or <br />modifications are proposed in Section .0104 to clarify issues <br />as noted below: <br />-- .0104(1) exemption to these rules may be granted by the <br />EMC <br />- .0104(n) cites related water supply protection rules <br />administered by the Division of Environmental <br />Health <br />- .0104(r) expansion of existing discharges <br />- .0104(s) definition of "existing" development <br />- .0104(t) requirements of "new" activity and provides <br />protection of water supplies during interim <br />period between classification and adoption of <br />local ordinances <br />- .0104(v) this provision previously appeared in the <br />specific criteria for all four classifications <br />but is now consolidated in this subparagraph <br />- .0104(w) clarifies the FMC's authority when assuming a <br />local watershed protection program <br />.0104(x) approval by the EMC of nonconforming activities <br />proposed by local governments <br />- .0104(y) references model local ordinances <br />• Clarification of Allowed Discharges. Proposed wording has <br />been added for each classification to more accurately explain <br />discharges that are or are not allowed in the watersheds. <br />+ Petroleum Contaminated Soils. New.permitted land <br />application sites for petroleum contaminated soils are not <br />allowed in.water supply critical areas in conjunction with <br />existing restrictions for sludge /residuals. - Section .0211 <br />• Allowable High Density Limit in WS -III Watershed Area. In <br />those areas outside the critical area of WS -III watersheds, <br />if high density development with engineered stormwater <br />control structures is allowed by the local governments it <br />is proposed that the maximum built -upon area limit be <br />increased from 30% to 50 %. - Section .0211(e)(3)(B)(i)(IV) <br />FN <br />
