For the purpose of these reclassifications, <br />the intent of "most appropriate classification" was interpreted to <br />be the highest classification for which a water supply qualified, <br />according to the adopted rules. A questionnaire was sent to each <br />affected local government requesting information on existing land <br />uses within their jurisdiction. The questionnaires were sent along <br />with specific instructions for providing explicit information on <br />existing development, including lands that had been platted or <br />zoned for specific uses. <br />The information that has been provided in response to the <br />questionnaires, in general, was not sufficiently explicit regarding <br />platted and zoned lands. Therefore, the proposed classifications <br />have been based upon the-best available information and, in some <br />instances, represent the best professional judgement of the Water <br />Quality Section staff of the DEM. Corrections, updates and <br />comments regarding the proposed reclassifications may be directed <br />to the Division during this public hearing process. In order to <br />document that a classification other than the one proposed is more <br />appropriate, supporting documentation, including additional <br />specific information on platted and zoned lands and existing-land <br />uses, should be provided during the hearing process. <br />L40difigations to A Eules <br />In reviewing the adopted water supply protection rules a few <br />issues were targeted for additional modification. In general, <br />these modifications are proposed to clarify requirements in the <br />adopted rules. The adopted rules with proposed modifications are. <br />included in Appendix C (proposed additions are underlined and <br />proposed deletions are struck through). The following list <br />outlines the proposed modifications to the rules as adopted by the <br />EMC. <br />• Stormwater Discharge. When the rules were adopted in <br />December 1990 it was not clear how federal stormwater rules <br />would be implemented on the state level. ftertreviewlarge <br />the stormwater requirements it became apparent <br />number of facilities would be required to implement <br />stormwater control practices to comply with the federal <br />criteria. To allow for compliance with federal stormwater <br />rules, provisions to allow stormwater discharge are <br />proposed to-be added to the adopted rules. These provisions <br />will allow stormwater discharge permits in water supply <br />watersheds as applicable. The additional provisions are <br />included in Sections .01010, .0211, and .0300. <br />• DOT Best Management Practices. The Department of <br />Transportation has developed a document (Water Supply <br />Watershed Best Management Practices) outlining BMP`s that <br />will be utilized in water supply watersheds. <br />- Section .0104(m) <br />2 <br />
