22 <br />from this procedure would require a modification by the <br />legislature of the statute. <br />MODEL WATER SUPPLY WATERSHED MANAGEMENT <br />AND PROTECTION ORDINANCE <br />The model ordinance with two exceptions provides a good basic <br />ordinance for a county which has no subdivision ordinance or <br />zoning ordinance. However, for counties which already have such <br />ordinances, this model ordinance provides absolutely no guidance <br />whatsoever. It would be of much more benefit to such counties if <br />model ordinances could be developed which would contain language <br />to implement density controls in subdivision ordinances and <br />zoning ordinances. <br />To the extent the model ordinance attempts to regulate . <br />agriculture and silviculture activities, this is prohibited by <br />G.S. S 153A -340 as indicated above. Also, the model ordinance <br />fails to include language providing for the "high density" option <br />asset forth in the regulations for development. <br />PETROLEUM CONTAMINATED SOILS <br />The proposed amendment to the rules which disallows new <br />permits for land application of petroleum contaminated soils is <br />supported by the County. The County believes that this has been <br />a shortcoming of the rules which allowed petroleum contaminated <br />soils in critical areas which provides for a much greater chance <br />of contamination of drinking water supplies than does <br />development. <br />Respectfully submitted, this.the 15th day of August, 1991. <br />S.
