W <br />terms and conditions of an approved Site Specific Development <br />Plan. <br />SUBDIVISION REGULATIONS TEXT AMENDMENTS <br />The proposed amendments to the Orange County Subdivision <br />Regulations are as follows: <br />1. Amend SECTION II DEFINITIONS by adding the definitions of <br />"Site Specific Development Plan" and "Vested Right" as <br />described above, and by amending the definition of "Minor <br />Subdivision" to exclude those subdivisions where an applicant, <br />at his /her option, requests a vested right for a period of <br />greater than one year. The net effect is to classify minor <br />subdivisions, for which approval of vested rights are <br />requested, as major subdivisions. <br />2. Amend SECTION III -D -2 PRELIMINARY PLAN APPROVAL by permitting <br />an applicant to request a vested right to carry out his /her <br />subdivision within a period of not less than two years and not <br />more than five years. To become vested, the Preliminary Plat <br />for the subdivision must be approved by the Board of <br />Commissioners as a Special Use, pursuant to Article 8 of the <br />zoning ordinance. <br />3. Amend SECTION IV- B -7 -b -6 PAYMENTS IN LIEU OF DEDICATION by <br />expanding the purpose for which payments in lieu of parkland <br />dedication may be used. Currently, payments in lieu may used <br />only for land acquisition-purposes. The proposed amendment <br />would permit payments in lieu to be used for development of a <br />park site as well as land acquisition. <br />i40=`�,I1 ##4de#aiAAuYj,f :41114 4 Z� <br />Three new application fees are proposed for addition to the <br />Schedule of Planning Fees. The first application fee is for the re- <br />approval of preliminary subdivision plats for which the time limits <br />have expired. The proposed fee is $60.00. <br />The remaining application fees both pertain to site plan <br />approval for non - residential projects. For those site plans which <br />require the certification of a registered engineer, architect, <br />landscape architect or surveyor, the proposed application fee is <br />$117.00. For those site plans where such certification is not <br />required, the proposed application fee is $60.00. <br />All interested citizens are invited to attend this hearing and <br />be heard. Public comment will be received during the public <br />hearing. Following the close of the public hearing, only evidence <br />received in writing by the date of the Planning Board meeting <br />following the public hearing will be considered by the Board of <br />Commissioners for decision. <br />Changes may be made in the advertised proposals which reflect <br />debate, objections and discussion at the hearing. <br />
