03 <br />density bonuses to include planned developments, site plans, <br />special use permits, and preliminary subdivision plats in <br />zoned townships. <br />3. Amend ARTICLE 8 <br />TIME LIMITS ON <br />under a Special <br />approval. Where <br />the Special Use <br />month extension <br />SPECIAL USES by adding.a new ARTICLE 8.4.11 <br />SPECIAL USES which requires that construction <br />Use Permit be started within one year of <br />construction is not started within one year, <br />Permit becomes null and of no effect. One six <br />may be requested. <br />The amendment also permits an applicant to request a vested <br />right to carry out his /her project within a period of not less <br />than two years and not more than five years. This latter <br />amendment is one of several proposed for the purpose of <br />implementing Senate Bill 766. <br />4. Amend ARTICLE 8.8 REGULATIONS GOVERNING INDIVIDUAL SPECIAL <br />USES by adding to subsection a) the requirement that 26 copies <br />of a preliminary plat be provided if the project involves a <br />subdivision rather than the site plan for a specific use. <br />5. Amend ARTICLE 8.8 by adding a new subsection entitled 8.8.27 <br />SITE SPECIFIC DEVELOPMENT PLANS which would require the <br />submission of additional information where an applicant wishes <br />to obtain approval of a Site Specific Development Plan and <br />acquire a vested right to carry out his /her project. The <br />proposed amendment also establishes standards for evaluating <br />Site Specific Development Plans. <br />6. Amend ARTICLE 14.3.2 SITE PLAN REVIEW by permitting an <br />applicant to request a vested right to carry out his /her <br />project within a period of not less than two years and not <br />more than five years. To become vested, the Site Plan for the <br />project must be approved by the Board of Commissioners as a <br />Special Use, pursuant to Article 8 of the Zoning Ordinance. <br />7. Amend ARTICLE 22- DEFINITIONS by amending and /or adding the <br />definitions of "Efficiency Apartment," "Site Specific <br />Development Plan," and "Vested Right." The definition of <br />"Efficiency Apartment" is being expanded to include a mobile <br />home. <br />A "Site Specific Development Plan" is defined generally as a <br />plan approved by the Board of Commissioners following a public <br />hearing and which describes, with reasonable certainty, the <br />type and intensity of use for a specific parcel or parcels <br />within the County's zoning jurisdiction. Such plans are <br />required only where an applicant wishes to vest his /her <br />property rights for a period longer than otherwise permitted <br />by ordinance. <br />"Vested right" is defined generally as the right to undertake <br />and complete the development and use of a property under the <br />
