BACK CREEK WATERSHED <br />A containment plan in the event of spill of failure, and appropriate safeguards against <br />contamination are required. <br />I I � R$WFVx� <br />A. The WS II classification proposed by the state matches that requested by Orange County <br />and Haw River. Alamance County and Mebane requested a lower classification (WS <br />III). A significant portion of the Town of Mebane is within this watershed. <br />B. There are no zoning controls in Cedar Grove Township. Extension of zoning standards <br />to Cedar Grove would provide a mechanism by which to apply the mandated standards. <br />While no zoning exists in this portion of the watershed, stormwater controls and stream <br />buffers are required through the County Subdivision Regulations. <br />C. The minimum lot size would increase from .92 acres to 2.0 acres throughout the <br />watershed. A new or revised zoning district and/or zoning overlay would have to be <br />created to specify the new standards. <br />D. Impervious surfaces would include gravel roads, drives, etc. Current regulations do not <br />consider such area as impervious surfaces. This change could create a problem during <br />in developing existing lots, particularly if they are non - conforming in size, and/or are <br />shaped such that a long driveway is required. <br />E. The minimum stream buffer would be increased from 50' to 100'. This could have a <br />substantial impact on existing lots that have limited buildable area, particularly those <br />created in Cheeks Township prior to 1984, which may not meet current minimum lot size <br />requirements. <br />F. Operation and maintenance of detention ponds or other engineered stormwater controls <br />will require oversight by the County. This will require development and implementation <br />of a monitoring program by the Erosion Control Division and/or County Engineer. <br />G. No area within the watershed is designated for non - residential use in the Land Use <br />Element of the Comprehensive Plan. The proposed regulations pertaining to non - <br />reWential watershed coverage and impervious surface would have little impact. <br />H. The Town of Mebane rezoned land in the watershed area in 1988 to meet the standards <br />of the old WS -11 classification - which were one -acre lots. As the rules stand now, the <br />Town may have to again downzone these areas to meet the proposed new WS -II <br />minimums. <br />39 <br />
