PROPOSED ORDINANCE AMENDMENT <br />ORDINANCE: Subdivision Regulations <br />REFERENCE: Section IV- B -7 -b -6 - Payments in Lieu of <br />Dedication <br />ORIGIN OF AMENDMENT: _X_ Staff Planning Board <br />BOCC Public <br />Other: <br />Expected Public Hearing Date: August 26, 1991 <br />Purpose of Amendment: To make the Subdivision Regulations <br />consistent with the General Statutes regarding the use of <br />funds received from payments made in lieu of recreation <br />dedication. <br />Impacts /Issues: The North Carolina General Statutes Chapter <br />153A- 331(a) describes the contents and requirements of a <br />county's subdivision control ordinance. Effective June 10, <br />1991, this Section, as applicable to Orange County, was <br />amended to allow the County to develop recreation areas using <br />funds received from subdividers who make payments in lieu of <br />dedicating land for recreation. Previously, the County could <br />only acquire land with payment -in -lieu funds, but not develop <br />it with money from the same source. <br />The proposed amendment to Section IV- B -7 -b -6 will include <br />development of recreation areas as a use for monies received <br />from payments made in lieu of dedication. <br />Existing and Proposed ordinance Provisions: <br />IV- B- 7 -b--6 Pa ents in Lieu of Dedication <br />Upon approval of the Board of Commissioners, <br />payment in lieu of dedication shall be made at <br />the time of final subdivision plan approval or <br />within one (1) year of approval of the prelimi- <br />nary subdivision plan, whichever occurs first. <br />All monies received by Orange County pursuant to <br />these requirements shall be used only for the <br />acquisition and development of recreation, park <br />and open space sites to serve the residents of <br />the development and the residents of the immedi- <br />ate neighborhood within which the development is <br />located. The Board of Commissioners shall also <br />have the authority to sell land dedicated <br />pursuant to these provisions with the proceeds of <br />any such sale used solely for the acquisition of <br />4- <br />15'7 <br />
