2 <br />SYNOPSIS OF TWO ZONING CASES <br />Or <br />CASE RECOMMENDED FOR DEMANDING PAYMENT OF CIVIL PENALTIES <br />Underwood Case ( #76) Summary <br />Location: 2524 Lannie Drive, Colonial Hills <br />Violations: Storage of goods, outdoors; storage of junk - <br />ed motor vehicles. <br />Status: Mr. Thomas W. Underwood was first contacted <br />by certified mail, return receipt requested, <br />on September 17, 1990 and again on November <br />13, 1990 (mailed to his mother, Mrs. Margaret <br />Underwood, 4010 Old NC 10, Durham, NC 27705, <br />in accordance with her request); and on Janu- <br />ary 31, 1991 (Explanation and assessment of <br />civil penalties mailed to his mother). Mrs. <br />Underwood acknowledged receiving the three <br />notices. <br />Attempts have been made to make arrangements <br />with salvage people to assist Mrs. Underwood <br />to have the vehicles and trash removed from <br />the premises. She said that her son would <br />not be willing to sell the vehicles for what <br />the salvage people would offer to rectify the <br />violation. Hence, no progress was made on <br />this front. <br />Mr. Underwood has physical disabilities which <br />have been described and verified by his phy- <br />sician, Timothy S. Carey, M.D., M.P.H., of <br />UNC Hospitals. A copy of his letter dated <br />February 19, 1991, is attached. <br />As directed by the Board, photographs of the <br />property were taken the morning after it's <br />May 6, 1991, meeting. On the premises there <br />were found a total of seven motor vehicles, <br />five of which appeared unable to be propelled <br />under their own power - -a Chevrolet service - <br />van, a Ford pick -up truck, a Buick four -door <br />sedan, an aluminum stepvan, and a large <br />three- wheeled motor - scooter van. Also on the <br />property are one circa 1940's mobile home - <br />travel trailer, one open trailer loaded with <br />razed building materials, one covered trailer <br />(Phillips Truck and Auto Service, Durham, <br />N.C.), one trailer frame, a riding lawn mow- <br />er, several stacks of bricks, several tires, <br />several large electric motors, junked home <br />air conditioners, household furniture, and <br />several piles of trash. <br />
