Charlotte County, Florida <br />The impact fees of Anne Arundel County, Maryland, <br />Charlotte County, Florida; Citrus County, Florida; and St. <br />Johns County, Florida, have been used as examples of the <br />various aspects of impact fee calculation. In this section, <br />those fees are set out as they were presented in the statement <br />of methodology accompanying the implementing or- <br />dinances. The following are direct quotations from those <br />methodology statements, edited only for grammatical cor- <br />rectness. These statements set out how the fees were <br />calculated and the various data sources that were used. <br />These portions of the methodology statements are includ- <br />ed for several reasons. First, they are included to provide a <br />full demonstration of fee calculations in one place. Second, <br />they are included as an example of a methodology state- <br />ment. A third reason is to show some of the difficulties of <br />C. Citrus County, Florida <br />D. St. Johns County, Florida <br />establishing impact fees and, last, to show the context of im- <br />pact fees. <br />Methodology statements are generally prepared for two <br />reasons. The first is to bring together the exact means, for- <br />mula, and assumptions used in the calculation of the fees and <br />to state the sources used. This is important in the event of <br />litigation or when updates are needed. Staff changes and <br />consultants moving on to other jobs will destroy the abili- <br />ty to recreate the system if it is not committed to paper. The <br />second reason they are prepared is as a tool to convince the <br />public, the press, and, potentially, a court of the <br />reasonableness of the calculations. Thus, there is a clear at- <br />tempt to be persuasive in the statements. Note might be <br />taken of the frequent indirect references to the rational nexus <br />proportionality criteria. <br />A. Anne Arundel County, Maryland, School Impact Fees <br />The following explanation of the proposed Anne Arundel <br />County school impact fee was in 'Technical Report on the <br />Methods Used to Calculate Impact Fees for Anne Arundel <br />County, "March 1987. This fee was adopted in August 1987 <br />and became effective immediately. This methodology <br />statement was prepared by James C. Nicholas for Anne <br />Arundel County, <br />METHODOLOGY <br />The method of calculating school impact is similar to that <br />for roads in that the primary factor is the quantity of <br />physical facilities required to accommodate new develop- <br />ment. Additionally, the proposed fees set out below are <br />based upon the recommendations of the Anne Arundel <br />County Study Committee on Bill 27 -87.
