EQUITY CONSIDERATIONS <br />Issue <br />Probably the most abstract and difficult issue to be addressed is one that does not appear in <br />written form anywhere in the proposed rules. This is the question of equity considerations for <br />watershed protection. Equity in this case can be defined in several forms: the question of equity <br />for upstream jurisdictions that protect water at their own cost for downstream area - while <br />receiving no direct benefit; or the localized question of individual property owners who protect <br />water supplies for the public good for which they cannot realize a direct benefit. <br />There are a number of different tools that can be considered here: monetary compensation, in- <br />kind compensation, water service extensions, et al. Orange County, as a headwaters jurisdiction, <br />is in the unique role of helping to protect water supplies for a number of other areas. <br />Possible Alternatimes <br />A. Pursue, through inter urisdictional meetings, discussion of watershed protection benefits <br />and costs. <br />B. Request downstream jurisdictions to compensate in -kind (treated water sale or other) for <br />protection of water supply. <br />C. Study possible means of passing on any compensatory receipts to property owners bearing <br />the burden of protection. <br />D. Commission a study to determine the effect of protection measures on property values. <br />E. Adopt protection measures for public good without compensation. <br />9.
