M M I ff V =s <br />the Comprehensive Plan. Adjacent land uses <br />are residential. <br />In 1988, a plan for Falling Cedars was <br />submitted for nine (9) lots. However, the <br />Health Department approved the Preliminary <br />for only eight (8) lots. The Final Plat was <br />approved with eight lots served by a Class B <br />private road and individual wells and septic <br />tanks. Two lots (1 & 7) had easements on <br />other lots for sewage disposal. <br />Following recordation of the Final Plat, the <br />owner acquired the services of a soil <br />scientist who was able to identify a ninth <br />location for sewage disposal that was <br />subsequently approved by Environmental <br />Health. The applicant has submitted a <br />revised Preliminary Plat to create the ninth <br />lot in Falling Cedars. <br />The total acreage of the tract is 20.53 <br />acres. The average lot size is 2.01 acres. <br />The new design has the same rod alignment and <br />basically the same lot layout. The septic <br />easements formerly located on lots 2 and 6 <br />have been removed. The sewage disposal areas <br />for lots 7 and 8 will be on a separate lot <br />owned in common by the owners of lots 7 & 8. <br />The Class B private road was constructed and <br />approved last year. The applicant's revised <br />private road justification and the staff's <br />evaluation of the request are attachments to <br />these minutes on pages <br />The factors used to justify the private road <br />are: <br />1. Larger lots than the minimum required; <br />2. Larger stream buffer; <br />3. Restrictive covenants to provide tree <br />protection and prohibit further <br />subdivision; <br />4. The subdivision will not be visible from <br />the State Road; and <br />5. Other subdivisions in the area are served <br />by private roads. <br />The Planning Staff recommends approval of the <br />Preliminary Plan for Falling Cedars Sub- <br />division with a Class B private road based on <br />the findings contained in section Iv- B -3 -d -1 <br />of the Subdivision Regulations and according <br />
