Kirk <br />responded that the request was made by <br />the applicant because a loss of one lot <br />would occur with a 50 -foot buffer. Also, <br />the same amount of plantings (screening) <br />would be installed as with a 50 -foot buffer. <br />Eidenier noted that a five -foot stockade <br />fence would be placed along lot #1; so the <br />view from US 70 would be the fence. <br />Waddell asked about the ultimate plan for US <br />70. Kirk responded that the Planning Staff <br />is not aware of any plans for additional <br />lanes for US 70 in this area.' <br />Scearbo informed the Board that Item F 4 in <br />the Resolution of Approval addresses the <br />concern regarding soil compaction tests. <br />Eidenier agreed. <br />Marvin Collins, Planning Director, reminded <br />the Board that the decision on the landscape <br />waiver rests with the Planning Director. He <br />noted that this was the first he had seen of <br />the proposed plan and indicated he would have <br />to review the criteria for a buffer waiver. <br />If the criteria is met, he can approve the <br />buffer waiver. <br />MOTION: Jobsis moved approval with the Resolution of <br />Approval and the additional conditions that <br />the property line dispute be settled prior to <br />final plat approval and that the standard 50- <br />foot buffer be required.
