The 50 foot right -of -way, containing 0.17 <br />acres, indicated at the end of Rod and <br />Reel Road shall be deeded to Orange <br />County. <br />These conditions are being addressed with the <br />application. The County Engineer has <br />reviewed, and is in general agreement with <br />the proposed plans and specifications for the <br />sewer design. Final plans and specifications <br />will be approved by the State Division of <br />Environmental Management and the Orange <br />County Engineer at the final plat stage. <br />The Planning Staff recommends approval of the <br />Preliminary Plan with the buffer waiver <br />subject to the Resolution of Approval (a copy <br />an attachment to these minutes on pages ). <br />Kirk informed the Board of a concern that has <br />arisen since agenda preparation. There is a <br />dispute about the exact location of the <br />eastern property line. Thus, the Planning <br />Staff recommends an additional condition be <br />added to the Resolution of Approval stating <br />that the property line dispute be settled <br />prior to final approval. <br />Eidenier asked if the property line dispute <br />would effect the number of lots. Kirk <br />responded that there is the possibility of <br />loss of one lot. <br />Eidenier asked about the possibility of soil <br />compaction tests. Kirk responded that a <br />large portion of this property was once a <br />ball field. The work that is done on a ball <br />field can cause compaction problems. When <br />the Building Inspector makes his initial <br />inspection, he would be able to determine if <br />a soil compaction test is needed. <br />Eidenier expressed concern that purchasers of <br />the lots would not be aware that a soil <br />compaction test could be required. Kirk <br />responded that a condition could be added to <br />the Resolution of Approval that a notation <br />be placed on the final plat declaration to <br />address this concern.. Eidenier asked that <br />this be done. <br />Eidenier stated she was opposed to the <br />applicant's request for a 30 -foot buffer. <br />She noted that this area is a high intensity <br />
