This buffer is required along US 70 (an arterial road) <br />according to Article IV- B -8 -e -3 of the Orange County Subdivision <br />Regulations. <br />Referencing Article IV -B -8 -g of the Orange County Subdivision <br />Regulations, statements below address the criteria for waiver <br />exemption: <br />(1) Due to the size of the proposed lot, a building site would <br />not meet setback requirements if a Type D buffer is enforced. <br />This request is to waiver only the dimensional requirements of <br />the buffer. The buffer standard would not be altered. Proposed <br />on Lot #1 is a five foot stockade fence that would run the entire <br />length of Lot #1 and parallel with US 70. Behind the fence, <br />Leland Cypress (evergreen) would be planted 30' on center to <br />create a semi - opaque screen to a height of 30'. With this <br />proposal, the developer plans to keep the purpose of the buffer <br />(screening) intact. <br />(2) Lot #20 is exempt from the required buffer because of the <br />existing commercial building located on this lot. Even though <br />the buffer is not applicable, any existing trees on this lot will <br />be maintained to benefit the purposes of screening. <br />(3) There are no existing improvements located on Lot #1; <br />however, a single wide mobile home is tentatively planned.
