4. The 50 foot right -of -way, containing 0.17 acres, 3 <br />indicated at the end of Rod and Reel Road shall <br />be deeded to Orange County. <br />These conditions are being addressed with the <br />application. The County Engineer has reviewed, and is <br />in general agreement with the proposed plans and <br />specifications for the sewer design. Final plans and <br />specifications will be approved by the State Division <br />of Environmental Management and the Orange County <br />Engineer at the final plat stage. <br />At its July 15, 1991 meeting, the Planning Board <br />recommended approval of the Preliminary Plan subject <br />to the attached Resolution of Approval. The Planning <br />Board added a condition to the Resolution that a <br />boundary line dispute be settled. This has been added <br />as item F5 in the Resolution. The Planning Board also <br />recommended against the requested buffer waiver <br />indicating that US 70 is considered an arterial <br />street in the Comprehensive Plan and the buffer should <br />remain 5o feet. <br />RECOMMENDATION: The Administration recommends approval of the <br />Preliminary Plan subject to the attached Resolution of <br />Approval, and denial of the buffer waiver, as per the <br />Planning Board Recommendation. <br />
