Subdivision Regulations Text Amendments <br />(1) Section IV- B -7 -b -6 <br />Payments in Lieu of Dedication <br />Presentation by Mary Scearbo. <br />The North Carolina General Statutes Chapter <br />153A- 331(a) describes the contents and <br />requirements of a county's subdivision <br />control ordinance. Effective June 10, 1991, <br />this Section, as applicable to Orange County, <br />was amended to allow the County to develop <br />recreation areas using funds received from <br />subdividers who make payments in lieu of <br />dedicating land for recreation. Previously, <br />the County could only acquire land with <br />payment -in -lieu funds, but not develop the <br />recreation area with monies from the same <br />source. <br />The proposed amendment to Section IV- B -7 -b -6 <br />will include development of recreation areas <br />as a use for funds received from payments <br />made in lieu of dedication. <br />The Planning Staff recommends that the <br />proposed amendment be advertised for public <br />hearing on August 26, 1991. <br />Waddell stated that the wording in the last <br />sentence of the proposed amendment should <br />read ...for the acquisition and development <br />of ... Scearbo responded that she would <br />verify this with the County Attorney, but, <br />felt the additional wording would be correct. <br />Waddell asked what the purpose of the "set <br />aside or payment -in- lieu" is.
