10 <br />1 B Special Use Permit. In commercial and office zoning districts, <br />2 such facilities are permitted by right. A day -care arrangement <br />3 which provides care for more than 5 children on a regular basis as <br />4 defined by the NC Child Day Care Ccmmission is considered a Day <br />5 Care and must receive approval of a Class B Special Use Permit from <br />6 the Board of Adjustment. Recently, Child Care Networks contacted <br />7 the Planning Department about a new category of child care <br />8 arrangement approved and licensed by the N.C. Child Day Care <br />9 Commission. The new category is a "large day care home" and is <br />10 termed a "home" because it is located in a family residence. A <br />11 large day care home may have up to 15 children, depending on their <br />12 ages. Child Care Networks requested that large day care homes be <br />13 permitted as a use by right. <br />14 <br />15 COHMENTS OR QUESTIONS FROM THE BOARD OF COY- MISSIONERS A2, -D /OR <br />16 PL7LhTNING BOARD <br />!7 <br />18 Commissioner Gordon indicated that she had several questions <br />19 for the County Attorney and that she would like to hold the Public <br />20 Hearing open until the next Board meeting. <br />21 <br />22 In response to a question from Mr. Eddleman, Mr. Kirk. <br />23 indicated that in a worst case situation, the Planning Staff <br />24 estimates that an additional 20 trips per day would be generated. <br />25 The small day care center is a permitted use which is not regulated <br />26 by County zoning. Therefore, they do not have statistics on <br />27 traffic generated by a small day care home. <br />28 <br />29 A.-my Rabb, Child Care Network, spoke in support of this <br />30 request. She indicated that this reauest would lessen the amount <br />31 <br />of red tape which is currently required to increase the number of <br />32 children in vour child care home. However, the regulations are <br />33 still in place to assure that the children are not going to receive <br />34 a lower quality of care or be placed in a less safe environment. <br />35 She indicated that there is a great need for homes of this size in <br />36 Orange County. <br />37 <br />38 A motion was made by Commissioner Gordon, seconded by <br />39 Commissioner Carey, to hold the Public Hearing open until the June <br />40 3, 2.991 Board of Commissioners meeting. <br />41 VOTE: UNANIMOUS <br />42 <br />43 5. SUBDIVISION REGULATIONS TEST AY.ZNDMENTS <br />44 A. Administrative Approval, of Expired Subdivision <br />45 Plats <br />46 This item was presented by Mary Scearbo. In summary, this <br />47 item was presented to receive public comment on a proposed <br />48 amendment to the Subdivision Regulations to allow staff re- <br />49 approval of expired Preliminary Plats. Under current procedures, <br />50 the Board of Commissioners may approve a revised phasing plan for <br />51 an expired Preliminary Plat. If a revision is not approved, the <br />52 expired portion of the Preliminary Plan must be re- submitted as if <br />it <br />
