3 <br />PROPOSED ORDINANCE AMENDMENT' <br />ORDINANCE: Water and Sewer Policy <br />Zoning Ordinance <br />Subdivision Regulations <br />REFERENCE: Goal 3.B.3. - Service Capability /Capacity/ <br />Extension Policies (page 7) <br />Article 6.15.2.a.2a.- Interim Development <br />Standards <br />Section IV- C- 2.a.2a) - Interim Development <br />Standards <br />ORIGIN OF AMENDMENT: _X_ Staff Planning Board <br />BOCC Public <br />Other: <br />Expected Public Hearing Date: August 5, 1991 <br />Purpose of Amendment: To allow valid water and /or sewer <br />agreements which predated the County's Water and Sewer Policy <br />to be carried out in the Rural Buffer and Water Quality <br />Critical Areas. <br />Impacts /Issues: In early April, a landowner in the <br />Protected Watershed portion of the University Lake Watershed <br />in the Rural Buffer visited the Planning Department to <br />inquire about developing an 18 -acre parcel. He brought with <br />him a copy of an agreement which he and his wife had signed <br />with OWASA in 1983 for the purpose of conveying a parcel of <br />land as a pump station location in exchange for five water <br />and five sewer taps. The pump station and taps were installed <br />by OWASA. The land owners would now like to use the taps and <br />develop their property. <br />OWASA officials have stated that they have no knowledge of <br />other similar agreements for water and /or sewer service. <br />Currently, the use of existing water and sewer taps in the <br />Rural Buffer would be in conflict with the County's Water and <br />Sewer Policy, since it prohibits extensions outside <br />Transition Areas with only a few specific exceptions (i.e., <br />public health emergency, necessary public facility). The <br />proposed amendment would add language to the Water and Sewer <br />Policy to allow pre - existing valid written service agreements <br />to be honored. To be considered valid, such an agreement must <br />involve a municipality (including Orange County) or a water/ <br />sewer authority as the service provider. <br />
