4 <br />2 s.. <br />Attorney was reviewing easement documents to permit the <br />septic system repair area for a dwelling to be located <br />on an adjoining residential lot. Located in University <br />Lake watershed, the situation prompted the County <br />Attorney to express concern to the Planning Director <br />about the application of the new standard to existing <br />lots and dwellings in the watershed. Specifically, if <br />the primary and /or repair nitrification field(s) for an <br />existing residence failed, and there was no suitable <br />location on the same lot for a repair field, the <br />standard would prevent the owner from residing in the <br />dwelling. Similarly, if an approved subdivision lot <br />has enough suitable soils for a system, but <br />insufficient soils for a repair area, the lot owner is <br />unable to use the approved lot. This latter situation <br />will not be common one; but it is likely to be more <br />than incidental. This is so because the soils analysis <br />done in the past for subdivision approval was based on <br />an assumed three - bedroom residence (Four bedrooms is <br />now assumed during the preliminary soils analysis.) If <br />a lot owner wants a house with four or more bedrooms on <br />an existing one -acre lot, there is more than a casual <br />chance that the lot will not accommodate a septic <br />system and a repair area. To eliminate such situations, <br />amendments to the Zoning Ordinance are needed. <br />The proposed amendments were presented at pudic <br />hearing on May 29, 1990. No comments were received <br />which would warrant changes to the proposed amendments. <br />The Planning Board considered the amendments at its <br />June 18, 1990 meeting and recommended approval of the <br />Proposals. Following the meeting, the amendments were <br />not placed on the Board of Commissioners August 6, 1990 <br />agenda for decision. <br />RECOMMENDATION: The Administration recommends approval of the proposed <br />amendments per the Planning Board recommendation, with <br />the additions as noted in boldface type. <br />
