It is <br />unwanted sex. It is isolation and intimidation. It is forced economic depen- <br />dency. <br />Within the legal system, you may choose to prosecute the assailant under <br />criminal laws. You may choose the civil procasa for protection, child <br />support /custody, separation/divorce. <br />CRIMINAL PROCESS <br />If you call law enforcement as a result of a battering incident, deputies and <br />police are authorized to (Chapter 50.8-5): <br />1. Arrest the batterer if there is probable cause evidence that a crime has <br />been committed. <br />2. Enforce temporary restraining orders. <br />3. Help you take out a warrant yourself with magistrate. (The most com- <br />mon warrants are Assault on a Female; Communicating.Threafs; Do- <br />mestic Criminal Trespass; all are misdemeanors.) <br />4. Help you obtain medical attention. <br />5. Escort you out of the house and to a safe place with your children. <br />6. Advise victims of domestic violence of shelter, counseling and support <br />services. <br />CIVIL PROCESS <br />A Temporary Restraining Order may be obtained by filing the appropriate <br />forms through the Clerk of Superior Court. It does not require an attorney to <br />file (this became effective January 1, 1990). <br />A Protective Order: <br />1. Orders the batterer to stay away from you, your home, work, school <br />and your children's school. <br />2. Can give you custody of the children and order safe visitation wish the <br />children, <br />3. Can order the batterer to pay you child support. <br />You will need an attomey to file for a court-ordered Separation (50 -B). The or- <br />ders may: <br />1. Direct the batterer to refrain from acts of harassment, threats and vio- <br />lence. <br />2. Grant the spouse/victim possession of the residence and order the <br />other spouse from the residence. <br />3. Award temporary custody of minor children to the victim. <br />4.
