Battering is not just a punch or a kick; it is harassment, threats, being thrown against walls, having things thrown at you, and being severely beaten. It is unwanted sex. It is isolation and intimidation. It is forced economic depen- dency. Within the legal system, you may choose to prosecute the assailant under criminal laws. You may choose the civil procasa for protection, child support /custody, separation/divorce. CRIMINAL PROCESS If you call law enforcement as a result of a battering incident, deputies and police are authorized to (Chapter 50.8-5): 1. Arrest the batterer if there is probable cause evidence that a crime has been committed. 2. Enforce temporary restraining orders. 3. Help you take out a warrant yourself with magistrate. (The most com- mon warrants are Assault on a Female; Communicating.Threafs; Do- mestic Criminal Trespass; all are misdemeanors.) 4. Help you obtain medical attention. 5. Escort you out of the house and to a safe place with your children. 6. Advise victims of domestic violence of shelter, counseling and support services. CIVIL PROCESS A Temporary Restraining Order may be obtained by filing the appropriate forms through the Clerk of Superior Court. It does not require an attorney to file (this became effective January 1, 1990). A Protective Order: 1. Orders the batterer to stay away from you, your home, work, school and your children's school. 2. Can give you custody of the children and order safe visitation wish the children, 3. Can order the batterer to pay you child support. You will need an attomey to file for a court-ordered Separation (50 -B). The or- ders may: 1. Direct the batterer to refrain from acts of harassment, threats and vio- lence. 2. Grant the spouse/victim possession of the residence and order the other spouse from the residence. 3. Award temporary custody of minor children to the victim. 4. Order the batterer to pay child support.
