` �T2 <br />NORTH CAROLINA FIRE WORKS DISPLAY <br />ORANGE COUNTY <br />AGREEMENT <br />�J <br />This agreement is entered into by and between the Town of <br />Chapel Hill, the Town of Carrboro, and Orange County, (hereinafter <br />"the Localities ") and Southern International Fireworks, Inc., <br />(hereinafter "Southern "). <br />WHEREAS, the Localities desire to have a fireworks display as <br />part of its Fourth of July celebration; and <br />WHEREAS, Southern is in the business of providing materials <br />and trained personnel to conduct such fireworks displays; <br />NOW, THEREFORE, in consideration of the premises and the <br />mutual promises set forth herein, the Localities and Southern <br />agree as follows: <br />SECTION 1. Subject to the remaining provisions of this <br />agreement, Southern shall furnish for and on behalf of the <br />Localities a fireworks display at the Ramshead Parking Lot (mortar <br />fireworks) and in Kenan Stadium (stationary fireworks) on the <br />University of North Carolina campus on July 4, 1991, beginning at <br />approximately 9:20 p.m. (subject to adjustment by the Localities). <br />a.) The amount and types of fireworks furnished by Southern <br />for this display shall be as described in Attachment A, which <br />attachment is incorporated herein by reference. <br />b.) Southern shall provide all equipment necessary to conduct <br />the fireworks display as well as trained and competent personnel <br />necessary to conduct this display. <br />c.) Southern shall comply with the following insurance <br />requirements: <br />1. Workers' Compensation: Coverage to apply for all employees for <br />statutory limits in compliance with the applicable state and <br />federal laws. The coverage must include Employer's Liability <br />with a minimum limit of $100,000 for each accident, $100,000 <br />bodily injury be disease each employee and $500,000 bodily <br />injury by disease policy limit. <br />2. Comprehensive General Liability: Coverage shall be minimum of <br />$1,000,000 per occurrence, combined single limit for bodily <br />injury liability and property damage liability. This shall <br />include products and /or completed operations, fireworks <br />display and shooting operations, and a contractual liability <br />endorsement. <br />
