The <br />engineering drawings for the remainder of the <br />treatment area have been prepared and will- <br />soon be submitted to DEM for review and <br />approval. <br />The proposed amendment for Phase Two is in <br />compliance with the standards of Section Iv- <br />B-10 of the Subdivision Regulations <br />pertaining to cluster developments. The <br />total area required for sewage disposal is <br />limited to fifty percent of the total open <br />space preserved in Piney Mountain. <br />Restrictive Covenants and Homeowners <br />Association documents recorded with Phase One <br />also apply to Phase Two including the <br />proposed amendment. <br />The Planning Staff recommends approval of the <br />amendment to the Preliminary Plat of Phase <br />Two of Piney Mountain Subdivision subject to <br />the conditions contained in the Resolution of <br />Approval (a copy is an attachment to these <br />minutes on pages ). <br />Mark O'Neal, developer, stated in reference <br />to A (2) of the Resolution, that the permits <br />for the monitoring wells would be issued by <br />the State rather than the County Health <br />Department. Cameron responded that this <br />question could be verified prior to the Board <br />of Commissioners meeting. She noted that A <br />(2) could be changed to read: Obtain approval <br />of the monitoring well(s) from the Orange <br />County Health Department Divison of <br />Environmental Health or State Division of <br />Water Quality. <br />,MOTION: Burklin moved approval as recommended by the <br />Planning Staff with the additional wording as <br />noted by Cameron.
