The applicant is <br />now requesting approval of an amendment to <br />Phase Two which involves relocating one lot <br />and adding additional area for nitrification <br />field. <br />Lot 45 will be relocated from its current <br />position south of lot 44 about 500 feet <br />southwest to the west side of lot 46. Orange <br />County currently owns the portion of the stub <br />out at Twin Pines Lane from the cul -de -sac to <br />the western corner of lot 46. This ownership <br />is on behalf of the public and without <br />maintenance responsibility. The applicant <br />will dedicate an additional 150 feet of <br />right -of -way to the public to extend the stub <br />out of Twin Pines Lane. <br />Rather than rebuild the cul -de -sac 140 feet <br />to the west to provide access for one lot, <br />the applicant has requested that the County <br />allow lot 45 to have a driveway within the <br />stub out (public right -of -way) to access the <br />existing cul -de -sac on Twin Pines Lane. <br />Again, the County has no maintenance <br />responsibility for the stub out. In the <br />event the adjacent property to the west is <br />developed, the stub out would be constructed <br />to NCDOT standards by the developer. <br />The area vacated by lot 45 will be added to <br />the existing Phase Two nitrification field at <br />the northwest corner of Twin Pines Lane and <br />Taproot Lane. An additional six acres to the <br />west will also be designated for <br />nitrification field and buffers. This area <br />will be owned and maintained by the utility <br />company which operates the community sewage <br />disposal system. <br />The.-need for additional sewage treatment area <br />is the result of two factors: <br />1. The nitrification fields are all wooded. <br />This makes it difficult to efficiently <br />use the entire field for sewage <br />treatment, since lines must be installed <br />to go around large trees. <br />2. The NC Department of Health, Environment <br />and Natural Resources adopted new buffer <br />requirements around low pressure <br />nitrification fields, resulting in a <br />
