STATEMENT OF JUSTIFICATION <br />Background: <br />This property was originally purchased by Everett Blackwood <br />as a site on which to build a small community shopping <br />facility. To this end he made application for the rezoning <br />of two acres of this property from R -1 to LC -1 to enable this <br />use. This change in zoning was approved on March 24, 1987. <br />He felt that with the residential growth in this area that <br />the facility which he envisioned would be very beneficial to <br />the White Cross Community. The nearest shopping facilities <br />are six miles to the East, in Carrboro. Commercially zoning <br />this property also compliments the Orange County Land Use - <br />Plan for Bingham Township. <br />Grading on the site has already been done and is complete at <br />this time. Mr. Blackwood obtained the proper erosion control <br />plan approval and grading permits on May 15, 1989. He thought <br />that when these were secured that he was ready to build, and <br />that securing the building permits was a matter of filing the <br />applications and paying the required fees. <br />It was at this point that he got several pieces of very bad <br />advice. First, from his builder who assured him that from <br />conversations that he had with Orange County that obtaining <br />these permits would be easy, this builder then sold four <br />buildings to Mr. Blackwood. When it was discovered that this <br />was a much more involved process, Mr. Blackwood then hired a <br />planner to help. <br />This planner, gave him more bad advice. He told him to start <br />on the construction of the project, and that he would secure <br />the needed permits. This only served to create a bigger mess <br />for Mr. Blackwood. In the meantime, stop -work orders were <br />issued for this project and remain in effect. <br />We have met with Marvin Collins and members of the Orange <br />County Planning staff about the problems with this property, <br />and discussed Mr. Blackwood's plans for the property. <br />U. <br />It has been determined that for Mr. Blackwood to proceed on <br />any plans for this property, he will need to rezone the back <br />portion of his residential property to allow for the <br />installation of a septic system. <br />0e <br />
