091 <br />PROPOSED ORDINANCE AMENDMENT <br />ORDINANCE: SUBDIVISION REGULATIONS <br />REFERENCE: SECTION III -D -2 -f ADMINISTRATIVE RE- APPROVAL <br />ORIGIN OF AMENDMENT: X Staff Planning Board <br />BOCC Public <br />Other: <br />STAFF PRIORITY RECOMMENDATION: r X High Middle Low <br />Comment: <br />EXPECTED PUBLIC HEARING DATE: May 28, 1991 <br />PURPOSE OF AMENDMENT: <br />To provide a procedure for administrative re- approval of <br />expired Preliminary Plats. <br />IMPACTS /ISSUES: <br />Under current procedures, an expired Preliminary Plat may be <br />extended upon approval by the Board of Commissioners of a <br />revised phasing plan. There are specific criteria for the <br />Board to consider when determining if the revision will be <br />approved. If a revision to the phasing plan is not approved, <br />then the applicant must re- submit the expired portion of the <br />Preliminary Plan as if it were a new project. <br />In many cases, the re- submitted Preliminary Plan is identical <br />to the original plat which was approved by the Board of <br />Commissioners. If there have been no major changes in <br />subdivision, zoning, or other regulations which affect the <br />proposal, then the Preliminary Plat is generally re- approved <br />with little or no change. Major design considerations and <br />other issues were addressed and resolved prior to the <br />original approval. <br />Where there have been no changes in regulations which affect <br />the subdivision, and no changes to the original proposal are <br />requested, the existing procedure of considering the <br />subdivision as if it were a new project is oriented largely <br />toward process, rather than substance. <br />The attached amendment is proposed to allow staff to re- <br />approve expired Preliminary Plats if: <br />- the original subdivision design and conditions of <br />approval are consistent with regulations in existence <br />at the time of application for re- approval, and <br />- any changes`to the original approval are <br />considered "minor changes ", which are technical rather <br />than substantive. <br />
