s <br />3 <br />PROPOSED ORDINANCE AMENDMENTS <br />ORDINANCE: Erosion Control Ordinance <br />: Sections 3, 4, 5, 7, 8, 9, 10, 15, 17, 18, 19, 21, <br />22, and 26 <br />ORIGIN OF AMENDMENT: X Staff Planning Board <br />BOCC Public <br />X Other: N.C. Sedimentation Control <br />Commission <br />STAFF PRIORITY RECOMMENDATION: X High Middle Low <br />PURPOSE OF AMENDMENTS: <br />To update the Ordinance so that it conforms with the State's Model <br />Ordinance, to improve enforcement and administration, and to <br />improve the readability of the Ordinance. <br />IMPACTS /ISSUES: <br />The amendments necessary to conform to the State's Model Ordinance: <br />add definitions; require increased protection for High Quality <br />Waters; allow enforcement action against forestry activity; allow <br />consideration of an applicant's past performance in granting <br />erosion control plan approval; increase the penalty for violations <br />from $100 to $500 per day; and make other administrative changes. <br />Amendments proposed by staff: add headings to the text, a table of <br />contents, and an index to improve readability; clarify the <br />jurisdictional boundaries; add a basic control objective so that <br />site designs are compatible with erosion control standards; clarify <br />the imposition of conditions of approval to erosion control plans; <br />and make minor administrative changes. <br />More detailed explanations of these changes are included in the <br />text of the proposed amendments and the accompanying commentaries. <br />EXISTING AND PROPOSED ORDINANCE PROVISIONS: <br />Refer to the attached amendments and commentaries. <br />PLANNING BOARD REVIEW: March 18, 1991 <br />BOCC REVIEW: <br />
