Box 8181 <br />HILLSBOROUGH, N.C. <br />27278 <br />I'm 4VK439+tll+40 IWOM �11 1 <br />Whereas, the Alexander vs Hill (Flaherty) Court order has <br />been in force for 16+ years with the intent of assuring <br />that applicants for Aid to Families with Dependent <br />Children and Medicaid receive timely determination of <br />eligibility; and, <br />Whereas, the most recent Consent Order and Settlement <br />Agreement signed by Legal Services and the State of <br />North Carolina creates sever fiscal sanctions for <br />Counties that fail to reach a certain point threshold on <br />an arbitrary, process- oriented monitoring mechanism; <br />and, <br />Whereas, the most recent Consent Order and Settlement <br />Agreement focuses on the process of determining <br />eligibility rather than the results, creates unnecessary <br />paperwork, and in effort, slows the eligibility process; <br />and, <br />Whereas, orange County is committed to providing assistance <br />to eligible applicants on a timely, accountable basis, <br />Now, Therefore, be it resolved that the Orange County Board <br />of Commissioners: <br />1., Request that all parties involved in the Court Order <br />enter into a cooperative effort to renegotiate and <br />modify the most recent Consent Order and Settlement <br />Agreement in a mutual effort to enhance humane, <br />efficient, and timely service; <br />2. Request that program regulations derived from Federal <br />Law, Court order, and State policy be modified to <br />simplify and speed the eligibility determination process <br />and that any system adopted to monitor that process be <br />designed to measure results rather than process; <br />3.
