This letter <br />will confirm that the request by Robert Ayers and Harold Harris <br />to amend the land use..element of the Orange County Comprehensive <br />Plan (CP -1 -91) was denied by =the Board.of County Commissioners on <br />May 6, 1991. <br />It is the practice ;.policy and procedure of the Board of <br />Commissioners that bases for decisions on building permits, <br />subdivision applications., or other "non - legislative" actions can <br />and are provided to applicants. However, the bases for decisions <br />of a legislative `nature.(i.e.,.comprehensive plan amendments, <br />zoning atlas or zoning ordinance text changes) are based on broad <br />goals and policies: Accordingly, it is not possible for the <br />Board to qualify legislative decisions. <br />The Orange County Comprehensive Plan is perhaps unique in <br />North Carolina in the strength of its linkage with implementing <br />ordinances such as the.Zoning Ordinance or Subdivision <br />Regulations. This linkage affords the county the opportunity to <br />ensure that the goals and policies contained within the plan are <br />directly reflected in the supporting ordinances. It also gives <br />the Comprehensive Plan a critical legislative role in defining <br />and ensuring public policy. As such, decisions to amend the <br />Comprehensive Plan must take into consideration not only <br />locational criteria of individual applications, but also the <br />broader concepts and goals relating to the health, safety and <br />general welfare of all county citizens. <br />With a copy of this letter to Marvin Collins, I have <br />enclosed a copy of Mr. Harris' May 20, 1991 letter to the Orange <br />County Board of Commissioners so that he might follow up on <br />keeping you informed of upcoming meetings and activities related <br />to the study of the I -40 /Old N.C. 86 interchange. <br />YOU COUNT IN ORANGE COUNTY !
