said premises or for any injury or damage caused by or resulting from Acts of God or the <br />elements, or from the acts of any other occupant of the premises. <br />8.4 NOTICE OF CASUALTY <br />Tenant shall give prompt notice to Landlord in case of fire or accidents in the Demised <br />Premises or in the building of which the Demised Premises are a part or of defects therein or <br />in any fixtures of equipment. In case Landlord shall without fault on its part be made a party <br />to any litigation commenced by or against Tenant, then Tenant shall protect and hold Landlord <br />harmless and shall pay all costs, expenses and reasonable attorney's fees. Tenant shall also pay <br />all costs, expenses and reasonable attorney's fees that may be incurred or paid by Landlord in <br />enforcing the terms of this lease. <br />1MIJI MEW <br />Tenant shall at all times during the term of this lease pay all premiums for and maintain <br />in full force and effect the following insurance in standard form generally in use in the State of <br />North Carolina with insurance companies authorized to do business in said State: <br />A. Comprehensive public liability insurance in the amount of at least $1,000,000.00 for <br />any occurrence resulting in bodily and personal injury to or the death of one person and <br />consequential damages arising therefrom, and in the amount of at least $1,000,000.00 for any <br />such occurrence for more than one person; <br />B. Comprehensive property damage insurance covering liability for damage to all <br />property in the amount of at least $100,000.00 for each occurrence either without the policy <br />containing the "care, custody and control" exclusion, or, in the alternative, providing fire and <br />extended coverage legal liability insurance; and <br />C. Tenant further agrees that the -contractor performing work for Tenant shall furnish <br />Tenant with certificates showing evidence of comprehensive public liability insurance in the same <br />amounts as set out in subsections (A) and (B). Such insurance to include "completed operations <br />coverage." Further, if any work involving excavation of underground operations should be <br />required, the XC&U exclusions must be omitted. <br />Such insurance and certificates shall name Landlord as an additional insured for the full <br />amount of the insurance herein required. Tenant, at the beginning of the term of this lease and <br />thereafter not less than thirty (30) days prior to the expiration of any such policy, shall furnish <br />Landlord with a standard certificate of insurance executed by the insurer involved also containing <br />an undertaking by the insurer to give Landlord ten (10) days prior written notice of any <br />11 <br />
