25 <br />portions of the original amendments - principally the <br />recommendation for extending public sewer lines into a predefined <br />corridor for Rural Village developments (similar to Fearrington <br />Village). The Committee's September 20 version addressed these <br />concerns by altering three sections of the original proposals - <br />dealing primarily with the means of sewer provision and the format <br />for approving five -acre lot subdivisions. <br />Since that time, attention has been focused on the amended version <br />of the recommendations and plan amendments. In the past month, <br />however, the comments of growth management attorney Robert Frielich <br />seem to diminish the strength of the argument against public sewer <br />extension that led to the September 20 amendment. The basis of the <br />argument against sewer line extension was that local governments <br />and OWASA would find it difficult to legally prohibit taps along <br />lines extended to Rural Villages. If so, this could place pressure <br />on future governing boards to relax density regulations and allow <br />higher density development - although this could not occur with <br />the JPA Plan concepts in place. Frielich argues, in essence, that <br />the original Rural Character proposals are the most effective way <br />to preserve character, and that there. exist legal mechanisms to <br />prohibit taps on lines extended to Rural Villages.
