10 <br />phasing plan was submitted before the <br />previously approved time limit(s) has lapsed; <br />and <br />(6) the possibility of practicality of the <br />subdivider and developer completing the <br />development project consistent with Orange <br />County regulations applicable if the phasing <br />plan amendment is not granted; and <br />(7) whether the time by which improvements must <br />be completed or installed would not be <br />extended by the revised phasing plan. <br />These phasing plan provisions were not in effect <br />when the Preliminary Plan for Phases II, III, and <br />IV of Cornwallis Hills was approved. <br />At that time, a preliminary plat could remain <br />valid as long as progress on completing <br />improvements continued and the period between <br />completion of phases did not exceed one year. <br />The letter of credit for Phases IIIA and IIIB was <br />released on April 4, 1990. Under the prior <br />provisions, the applicant has until April 4, 1991 <br />to receive approval of the Final Plat for Phase <br />IV. In order to obtain Final Plat approval, the <br />improvements would have to be completed, or <br />secured through a letter of credit or other <br />acceptable means. The letter of credit could <br />remain valid for 1 year, and would have to expire <br />no later than April 4, 1992. <br />Due to slow lot sales during the past year, the <br />applicant has not proceeded with development of <br />Phase IV. The applicant has requested additional <br />time to record the last Final Plat. The <br />preliminary plat complies with current <br />regulations and standards. <br />Factor (7) allows for time extensions which do <br />not extend the date by which improvements are <br />completed. The effect of a time extension <br />approved under this provision would be to provide <br />flexibility in the plat approval date, but would <br />provide for no change in the deadline for <br />completion of improvements. <br />It is recommended that the deadline for Final <br />Plat approval be extended to December 31, 1991, <br />as requested by the applicant.
