M <br />G.S.16OA -400.9 also requires that property owners, <br />likely to be affected by the application, be given <br />notification and an opportunity to comment The 15 -day <br />notification period is identical to that required for <br />rezoning requests. <br />Section 4.6 Review Standards <br />No Certificate of Appropriateness shall be granted <br />unless the Commission finds that the application complies <br />with the principles and guidelines adopted by the Commission <br />for review of exterior changes. It is the intent of these <br />principles and guidelines to insure insofar as possible that <br />the exterior portion of buildings, structures, and their <br />appurtenant features within historic districts or on <br />buildings, structures, sites, areas or objects designated as <br />landmarks, shall be congruous with the historic aspects of <br />the district or landmark. <br />As part of the review procedures, the Commission may <br />view the premises and seek the advice of the N.C. Department <br />of Cultural Resources or other such expert advice as it may <br />deem necessary under the circumstances. <br />The Secretary of the Interior's " Standards for <br />Rehabilitation and Guidelines for Rehabilitating Historic <br />Buildings" shall be the sole principles and guidelines used <br />in reviewing applications of the State of North Carolina for <br />Certificates of Appropriateness. <br />G.S.160A -400.9 requires the Commission to prepare and <br />adopt design principles and guidelines applicable to new <br />construction, alterations, additions, etc. and use them in <br />deciding on whether or not to issue a Certificate of <br />Appropriateness. Written notice of the intent to <br />appeal must be sent to the Commission, postmarked within <br />thirty (30) days following the decision. Appeals shall be in <br />the nature of certiorari. Appeals of decisions of the Board <br />of Adjustment shall be heard by the Superior Court of Orange <br />County. <br />
