22 <br />ordinance designating a historic landmark, written notice <br />shall be sent by certified mail to the property owner within <br />five (5) working days of the Board's decision. <br />Following the public hearing, the Board of Commissioners <br />may adopt as proposed, adopt with amendments or reject the <br />proposed ordinance (G.S.160A- 400.6). Although not required by <br />the enabling legislation, the Board of Commissioners must <br />await the recommendation of the Commission or the passage of <br />60 days, which ever occurs first. This provision is based on <br />a similar procedure involving Planning Board recommendations <br />(Article 20.7 - Zoning Ordinance). <br />The ordinance must contain a concise statement of <br />exactly what is being designated as a landmark (Beth Thomas, <br />recommendation), the names of the property owner(s), the <br />elements of the property contributing to its significance, <br />and other information deemed necessary. The ordinance must <br />also require that the waiting period required by G.S.16OA- <br />400.9 be observed (G.S.16OA- 400.5). <br />Seetio 3.10 Action Subsequent to Board A roval <br />Upon adoption of the ordinance, the owners and occupants <br />of each landmark shall be given written notification of such <br />designation by certified mail. In addition, copies of the <br />ordinance and all amendments thereto shall be distributed as <br />follows: <br />1. A copy of the ordinance and all amendments thereto <br />shall be filed by the Commission in the Office of <br />the Register of Deeds. Each landmark shall be <br />indexed according to the name of the owner of the <br />property in the grantor and grantee indexes in the <br />Register of Deeds Office and the Commission shall <br />pay a reasonable fee for filing and indexing. <br />2. A copy of the ordinance and all amendments thereto <br />shall be kept on file in the Office of the Clerk to <br />the Board of County Commissioners and be made <br />available for public inspection at any reasonable <br />time. <br />3. A copy.of the ordinance and all amendments thereto <br />shall be submitted to the Planning and /or <br />Inspections Department. <br />4. A copy of the ordinance and all amendments thereto <br />shall be given to the Tax Supervisor. The <br />designation and any recorded restrictions upon the <br />property limiting its use.for preservation purposes <br />
