20 <br />specified in Section 3.5, the Commission may recommend to the <br />Board of County Commissioners that the property be designated <br />as a historic landmark. <br />Prior to the meeting of the Commission at which the <br />recommendation will be considered, written notice shall be <br />sent to the affected property owner and all adjacent owners <br />in accordance with the notification procedures set forth in <br />Section 3.4 above. <br />If the Commission recommends that the property be <br />designated as a historic landmark, it shall submit a copy of <br />the designation report, the comments of the N.C. Department <br />of Cultural Resources, the minutes of the meetings at which <br />the designation was considered, and a proposed ordinance of <br />designation to the Board of County Commissioners, requesting <br />that a joint public hearing as required by Section 3.7 be <br />called on the proposed ordinance. <br />Following receipt of NCDCR comments or the passage of 30 <br />days, the Commission may prepare a recommendation on the <br />designation..A recommendation is required by G.S.160A -400.5 <br />as is a finding that the property is of special <br />significance. <br />Section 3.7 Public Hearing and Notice Thereof <br />A joint public hearing involving the Commission and the <br />Board of County Commissioners shall be held before adoption <br />of a proposed ordinance designating a historic landmark. <br />Notice of the public hearing shall be published once a week <br />for two successive calendar weeks. The notice shall give the <br />date, time, and place of the public hearing, and shall be <br />published the first time not loss than 10 days nor more than <br />25 days before the date fixed for the hearing. In computing <br />such period, the day of publication is not to be included but <br />the day of the hearing shall be included. <br />Written notice shall also be sent by certified mail to <br />the affected property owner and all adjacent owners not less <br />than 15 days before the hearing date. Adjacent property <br />owners are those whose names and addresses are currently <br />listed in the Orange County tax records and whose property <br />lies within 500 feet of the affected property. <br />G.S.160A -400.6 requires that the Commission and Board of <br />Commissioners hold joint or separate public hearings on the <br />proposed ordinance. Reasonable notice of the time and place <br />is also required. The notification procedures above are the <br />same as those required in the case of a rezoning <br />application. <br />
