W <br />The enabling legislation requires that the Commission <br />make or cause to be made an investigation and report on the <br />significance of the building or buildings proposed for <br />designation (G.S.16OA- 400.6). The Planning & Inspections <br />Department mould have responsibility for preparation of the <br />report. <br />In her 317191 letter, Beth Thomas notes that a concise <br />statement of what is being proposed for designation should be <br />required. Outbuildings which may be included in the <br />designation should be described, photographed, and mapped. It <br />is also important to provide a statement justifying the <br />inclusion "of land which may be designated. Section 3.3 has <br />been amended to address these concerns - see underlined text <br />above. <br />Section 3.4 initial Consideration of Desi nati n Re crt b <br />Commission <br />The Planning and Inspection Department shall submit the <br />application for historic landmark designation and . <br />accompanying designation report to the Commission at the <br />first regular meeting after the expiration of the 30 -day <br />period specified in Section 3.3 or any extension thereof.. <br />Prior to the meeting of the Commission at which the <br />application and report will be considered, written notice <br />shall be sent by-certified mail to the affected property <br />owner and all adjacent owners not less than seven (7) days <br />before the meeting date. Adjacent property owners are those <br />whose names and addresses are currently listed in the Orange <br />County tax records and whose property lies within 500 feet of <br />the affected property. <br />At the meeting, the Commission may accept the <br />designation report, accept it with amendments, reject it or <br />recommend it for further study. No property shall be <br />accepted for designation as a landmark unless it is deemed <br />and found by the Commission to be of special significance in <br />terms of its historical, prehistorical, architectural, or <br />cultural importance, and to possess integrity of design, <br />setting, workmanship, materials, feeling, and /or association. <br />If the report is accepted or accepted with amendments, <br />the Commission shall forward a'copy to the N.C. Department of <br />Cultural Resources in accordance with the provisions of <br />Section 3.5 below. <br />The.purpose of this meeting is for the Commission to <br />receive the designation report as prepared by the Planning & <br />Inspections Department.
