15
Following the public hearing, and upon receipt of the
report and recommendations, the Board of Commissioners may
proceed in the same manner as required for the adoption of
any zoning ordinance provisions. Article 20.7 of the Zoning
Ordinance requires the Board of Commissioners to await the
recommendation of the Planning Board or the passage of 6.0
days, which ever occurs first. This provision.has been
amended to require the Board of Commissioners to await the
recommendation of the Commission. The Planning Board
recommendation will have already been prepared and submitted
to the Commission.
In her 317191 letter, Beth Thomas of NCDCR questions
whether the 180 -day waiting period set forth in Section 4.9
must.be observed prior to the demolition of any building,
structure, site, area or object in a historic district. G.S.
160A -400.5 makes reference to a waiting period only for
landmarks. While there is no equivalent wording in the
statutes for structures, etc. in districts, G.S. 160A- 400.14
is very specific in making the delay period applicable to a
"designated landmark or a building, structure or site within
the district... ". For this reason, the ordinance wording is
left unchanged.
