Kevin <br />Huggins, applicant for Crescent Ridge Subdivision. The <br />property is located on the north side of Dairyland Road (SR <br />1113) at the intersection of Albert Road (SR 1179) in Chapel <br />Hill Township. A waiver has been requested for the planting <br />requirements on lots 1 and 19 within a Type A 30 -foot Land <br />Use Buffer between a collector road and the proposed <br />residential land use. <br />Section IV -B -8 -g of the Subdivision Regulations (Amended 4- <br />17-90) authorizes the Board of Commissioners to waive addi- <br />tional planting requirements when one or more of the <br />following conditions exists: <br />1) the topography of a site and /or the size of a proposed <br />lot is sufficient to serve the purpose of a buffer; <br />2) existing structures, utilities, gardens or active <br />farmland are located in the buffer or setback areas; or <br />3) an existing residence or structure with established <br />lawn areas and /or plant beds is contained within a <br />proposed subdivision lot. <br />The applicant's letter and a subsequent inspection of the <br />proposed subdivision produced the following facts in support <br />of a waiver. Most are illustrated on the attached landscape <br />plan: <br />1. Both lots are 5.01 acres in size. Although this <br />subdivision is partially in the University Lake <br />Watershed, a limited number of 2 -acre lots are allowed. <br />Therefore, lots 1 and 19 are 2.5 times larger than the <br />minimum required. <br />2. Part of the required buffer as shown on the landscape <br />plan contains an embankment up to six feet above the <br />- -- level of Dairyland Road. The bank will be partially <br />n <br />
