ORANGE COUNTY PLANNING DEPARTMENT
306F REVERE ROAD
HILLSBOROUGH. NORTH CAROLINA 27278
M ORANDUM
TO: Board of County Commissioners
Planning Board
FROM: Emily Cameron, ASLA Planner II
SUBJECT: Land Use Buffer Waiver Request - Crescent Ridge
DATE: March 1, 1991
10
This Land Use Buffer waiver request is submitted by J. Kevin
Huggins, applicant for Crescent Ridge Subdivision. The
property is located on the north side of Dairyland Road (SR
1113) at the intersection of Albert Road (SR 1179) in Chapel
Hill Township. A waiver has been requested for the planting
requirements on lots 1 and 19 within a Type A 30 -foot Land
Use Buffer between a collector road and the proposed
residential land use.
Section IV -B -8 -g of the Subdivision Regulations (Amended 4-
17-90) authorizes the Board of Commissioners to waive addi-
tional planting requirements when one or more of the
following conditions exists:
1) the topography of a site and /or the size of a proposed
lot is sufficient to serve the purpose of a buffer;
2) existing structures, utilities, gardens or active
farmland are located in the buffer or setback areas; or
3) an existing residence or structure with established
lawn areas and /or plant beds is contained within a
proposed subdivision lot.
The applicant's letter and a subsequent inspection of the
proposed subdivision produced the following facts in support
of a waiver. Most are illustrated on the attached landscape
plan:
1. Both lots are 5.01 acres in size. Although this
subdivision is partially in the University Lake
Watershed, a limited number of 2 -acre lots are allowed.
Therefore, lots 1 and 19 are 2.5 times larger than the
minimum required.
2. Part of the required buffer as shown on the landscape
plan contains an embankment up to six feet above the
- -- level of Dairyland Road. The bank will be partially
n
