To consider release of bid security. <br />BACKGROUND: On March 4, 1991 the Board authorized the withdrawal of a <br />bid from Rural Plumbing and Heating Company for work proposed on the <br />911 Center Expansion Project. G.S. 143 -129.1 requires the County to <br />conduct a hearing prior to release of the bid security which presents <br />evidence that the bid was based upon a mistake which constituted a <br />substantial error. <br />The evidence must show the following: <br />1. The bid was submitted in good faith; <br />2. The Bidder has submitted credible evidence that the mistake <br />was clerical in nature rather than an error in judgement; <br />3. The error was due to an unintentional and substantial <br />arithmetic error or an unintentional omission of a substantial <br />quantity of work, labor, materials or services made directly in <br />the compilation of the bid. <br />The Architect has reviewed the bid with Rural Plumbing and Heating and <br />is satisfied that the aforementioned conditions were met and that the <br />bid price was based on a substantial error. <br />The statute further states that the bid may be withdrawn without <br />forfeiture of the bid security if the bid was based upon a mistake. <br />RECOMMENDATION: Approve the return of the bid security to Rural <br />Plumbing and Heating; and authorize the Director of Purchasing and <br />Central Services to notify Rural Plumbing & Heating in writing of the <br />decision. <br />
