15( <br /> the exterior. portion of buildings, structures, and their <br /> appurtenant features within historic districts or on <br /> buildings, structures, sites, areas or objects designated as <br /> landmarks, shall be congruous with the historic aspects of <br /> the district or landmark. <br /> As part of the review procedures, the commission may <br /> view the premises and seek the advice of the N.C. Department <br /> of Cultural Resources or other such expert advice as it may <br /> deem necessary under the circumstances. <br /> The Secretary of the Interior's " Standards for <br /> Rehabilitation and Guidelines for Rehabilitating Historic <br /> Buildings" shall be the sole principles and guidelines used <br /> in reviewing applications of the State of North Carolina for <br /> Certificates of Appropriateness. <br /> G.S.160A-400.9 requires the Commission to prepare and <br /> adopt design principles and guidelines applicable to new <br /> construction,. alterations, additions, etc. and use them in <br /> deciding on whether or not to issue a Certificate of <br /> Appropriateness. G.S.160A-400.9 also permits the Commission <br /> to visit the site and seek expert advice. Where applications <br /> of the State are considered, only the Secretary of the <br /> Interior's " Standards for Rehabilitation and Guidelines for <br /> Rehabilitating Historic Buildings" shall be used. <br /> Section 4.7 AvReals of Co ission Actions <br /> In any action granting or denying a Certificate of <br /> Appropriateness, an appeal by an aggrieved party may be taken <br /> to the Board of Adjustment. Written notice of the intent to <br /> appeal must be sent to the commission, postmarked within <br /> thirty (30) days following the decision. Appeals shall be in <br /> the nature of certiorari. Appeals of decisions of the Board <br /> of Adjustment shall be heard by the Superior Court of orange <br /> County. <br /> The State of North Carolina shall have a right of appeal <br /> to the North Carolina Historical Commission, which shall <br /> render its decision within thirty (30) days from the date <br /> that a notice of appeal by the state is received by the <br /> Commission. The decision of the Commission shall be final <br /> and binding upon both the State and the commission. <br /> Appeals by a citizen of actions taken by the Commission <br /> are to the Hoard of Adjustment. Appeals by the State are to <br /> the North Carolina Historical commission (G.S.160A-400.9) . <br />
