14 .� <br /> listed in the Orange County tax records and whose property <br /> lies within 500 feet of the affected property. <br /> G.S.160A-400.6 requires that the Commission and Board of <br /> Commissioners hold joint or separate public hearings on the <br /> proposed ordinance. Reasonable notice of the time and place <br /> is also required. The notification procedures above are the <br /> same as those required in the case of a rezoning <br /> application. <br /> Section 3.8 Commission Action Subsequent to Public Hearin <br /> Within 60 days following the date of the public hearing, <br /> the Commission shall prepare and submit to the Board of <br /> Commissioners a recommendation concerning the disposition of <br /> the proposed ordinance. The Commission may recommend: <br /> 1. Adoption of the ordinance as proposed; <br /> 2. Adoption of ordinance subject to conditions; or <br /> 3. Denial of the ordinance. <br /> Failure of the Commission to submit a recommendation <br /> within the required time shall be considered a favorable <br /> recommendation, without conditions. The time limit may be <br /> extended upon request of the applicant. <br /> Commission action following the public hearing is not <br /> required by the enabling legislation. However, it has been <br /> included as part of the designation procedure. it is modeled <br /> after similar provision applicable to the Planning Board. <br /> Section 3.9 Hoard Action subsequent to Public Hearing <br /> Upon complying with the required landmark designation <br /> procedures set forth above, the Board of Commissioners may <br /> consider the adoption and from time to time the amendment or <br /> repeal an ordinance designating a historic landmark. The <br /> ordinance shall describe the property, the name or names of <br /> the owner or owners of the property, those elements of the <br /> property that are integral to its historical, architectural <br /> or prehistorical value, including the land area of the <br /> property so designated, and any other information the <br /> governing board deems necessary. For each building, <br /> structure, site, area or object so designated as a landmark, <br /> the ordinance shall require that the waiting period set forth <br /> in Section 4.9 this ordinance be observed prior to its <br /> demolition. <br /> The Board of Commissioners shall not consider enactment <br /> of a proposed ordinance until 60 days after the date of the <br /> public hearing or until the Commission prepares its <br />
