Amendments to the Orange County i <br /> Soil Erosion and Sedimentation Control Ordinance <br /> Notes: The underlined text will be added to the Ordinances and the crossed-through text deleted. <br /> Most of these amendments are required by the North Carolina Sedimentation Control <br /> Commission for the Ordinances to comply with the State's Model Ordinance. Other <br /> amendments not required by the State are noted in the commentary as being proposed by <br /> the staff. <br /> All Sections of the Ordinance <br /> The subheadings underlined and in this font shown in the following amendments will be added and others, <br /> not shown in this document, will be added throughout the Ordinances to improve readability. Every example <br /> of these headings is not included in these amendments because they do not change the Ordinance. <br /> Section 3 Definitions <br /> Completion of Construction or Development:means that no further land-disturbing activity,+,is required on a <br /> phase of a proiect except that which is necessary for establishing a permaneLt ground cover. <br /> COMAff TARY.- This definition will be added to the Ordinance. <br /> Department: means the North Carolina Department of <br /> Environment. Health, and Natural Resources. <br /> COMMENTARY. TIZe name of this State agency has been changed. <br /> Discharge Point: means that point or points_at which runoff leaves a tract of land. <br /> COJOWMARY.• This definition will be added to the Ordinance. <br /> High Quality Waters: means those classified_as such_in IM NCAC 2B.0101(e)(5) General Procedures, <br /> which is incomorated herein by reference_ to include further_ amendments pursuant to G.S. 150B-14(c). <br /> Explanatory Note: The complete official definition of High Quality Waters is contained in 15A NCAC <br /> 2B.0101(e) (5) - General Procedures. In general. High Quality Waters are defined by the Division of <br /> Environmental Management as those waters which are: those rated as excellent based on biological and <br /> physical/chemical characteristics: native trout waters: primary or functional nurserLareas, critical habitat <br /> areas: all water sunnly watersheds which are either classified as WS-I or WS-11 or those for which a <br /> formal petition for reclassification as WS-I or WS-II has been received by the Division of Environmental <br /> Management: and all Class SA (shellfish) waters. <br /> COMMENTARY.- This definition along with the note will be added to the Ordinance. <br /> High Oualily Water (HOW) zones: means areas in the Coastal Counties that are within 575 feet of High <br /> Quality Waters. and for the remainder of the state areas that are within one mile and drain to HQW's. <br /> COMMENTARY.• High Quality Waters in Orange County are University Lake (WS-I) and Cane Creek(W5- <br /> I) watersheds and the North and South Forks of the Little River (proposed WS-I) because of their water <br /> supply watershed classifications. Seven Mile Creek would become an HQW if the requested change to its <br /> classification is approved by the State. <br /> Local Government:means any county, incorporated village, town or city, or any combination of counties, <br /> 1 1-15-91 <br />
