4P <br />a <br />PROPOSED ORDINANCE AMENDMENT <br />2 <br />ORDINANCE: Zoning Ordinance <br />REFERENCE: Article 2.4.2.1(e) (Development Advisory Committee) <br />ORIGIN OF AMENDMENT: Staff Planning Board <br />BOCC Public <br />Other: County Attorney <br />STAFF PRIORITY RECOMMENDATION: X High Middle Low <br />Comment: <br />PUBLIC HEARING DATE: December 11, 1990 <br />PURPOSE OF AMENDMENT: <br />To consider a Zoning Ordinance amendment to delete any role of the <br />Development Advisory Committee in the issuance of Stop Work Orders. <br />IMPACTS /ISSUES: <br />On October 17, 1989, the Board of Commissioners approved an amendment <br />which allows the Zoning Officer is issue a Stop Work order for activity <br />which violates provisions of the Zoning Ordinance and could cause <br />irreparable injury if allowed to continue. <br />The amendment involved changes to several sections of the Ordinance. <br />Article 23 (Violations, Penalties and Remedies) was amended to <br />establish a Stop Work Order as a penalty for a violation. Article <br />2.3.3 (Board of Adjustment Administration) was amended to establish an <br />appeal procedure. Article 2.4.2.1 was amended to expand the duties of <br />the Development Advisory Committee to render advise to the Zoning <br />Officer in the issuance of Stop Work Orders. <br />The County Attorney has indicated that the Development Advisory <br />Committee should have no role in the enforcement of the Ordinance. In <br />practice, decisions regarding Stop Work Orders have been made by the <br />Zoning Officer, with input from the County Attorney when needed. <br />The proposed amendment would delete paragraph 2.4.2.1(e), which was <br />inadvertently recommended for approval on October 17, 1989. <br />EXISTING AND PROPOSED ORDINANCE PROVISIONS: <br />2.4.2.1 Duties and Responsibilities <br />The Development Advisory Committee has the following duties <br />and responsibilities. The Committee shall: <br />a) Review proposed amendments, Planned Developments, <br />Special Uses, rezonings, and subdivisions for the Zoning <br />Officer on the technical issues raised; and <br />
