The amendment <br />provides a remedy for development plans for which the 12 -month time <br />limit for obtaining Final Plat approval had expired or was about to <br />expire. Six criteria used to justify revised phasing plans were set <br />forth in Section III- D -2 -e. <br />On September 4, 1990, the Board of Commissioners approved a revised <br />phasing plan for Four Birches Subdivision. The Preliminary Plat for <br />Four Birches expired on August 1, 1990. Road and landscaping <br />improvements were not complete, and there had been no security posted <br />to assure their completion. The revised phasing plan allowed an <br />additional four months (December 1, 1990) to receive Final Plat <br />approval. If the improvements are not completed by that time, then <br />security must be posted. However, conditions of the phasing plan <br />approval state that, even if secured, the improvements must be <br />completed by August 1, 1991. Had the subdivision been approved <br />on August 1, 1990, security could have been posted for a period of one <br />year, requiring the applicant to complete the improvements by that <br />same date of August 1, 1991. <br />Four Birches' justification for a revised phasing plan, when compared <br />with the current criteria set forth in Section II- D -2 -e, did not <br />present a strong case for approval. The fact that proposed phasing <br />would not extend the time limit for completion of improvements was the <br />basis for the administration's recommendation for approval, and the <br />Board of Commissioners approval of the Four Birches phasing plan. <br />The Board of Commissioners directed Staff to prepare an amendment to <br />Section II -D -2 -e allowing approval of a phasing plan if the time <br />available to install improvements was not extended. <br />
