r occur when the first alteration of any wall, ceiling, floor, <br />or other structural part of the building commences, whether <br />or not that alteration effects the external dimensions of the <br />structure. The term does not, however, include either (1) <br />any project for improvement of a structure to comply with <br />existing state or local health, sanitary, or safety code <br />specifications which are solely necessary to assure safe <br />living_conditions or (2) any repair, rehabilitation or <br />restoration of a structure listed on the National Register of <br />Historic Places or the State of North Carolina Inventory of <br />Historic.Places. <br />"Variance" means a relaxation of the terms of this ordinance <br />where such relaxation will not be contrary to the public <br />interest and where, owing to conditions peculiar to the <br />property and not the result of actions or the situation of <br />the applicant, a literal enforcement of the ordinance would <br />result in unnecessary and undue hardship. <br />4.5 MANUFACTURED HOMES <br />a. On the effective date of this ordinance, no <br />manufactured home shall thereafter be placed in a - <br />floodway. In an existing manufactured home park or <br />subdivision, a manufactured home removed may be <br />replaced at the same location. <br />b. All manufactured homes to be placed or <br />substantially improved within Zones A1-30, AH, and <br />AE shall be elevated on a permanent foundation such <br />that the lowest floor of the manufactured home is <br />at or above the base flood elevation, provided, <br />however, the elevation requirement applies only to <br />manufactured homes placed or substantially improved <br />in expansions to existing manufactured 'home Darks <br />or subdivisions. The elevation requirement does <br />not apply to other manufactured homes placed or <br />substantially improved in existing manufactured <br />home parks or subdivisions except where the repair, <br />reconstruction, or improvement of the streets, <br />utilities or NO in the existing manufactured home <br />parks equals or exceeds fifty percent (50 %) of the <br />value of the streets, utilities or pads. <br />(AMMUD 9-20-8S) <br />In addition, all manufactured homes to be _placed or <br />substantially improved within Zones P_1 -30, RE, and <br />PE shall be securely anchored to an adequately <br />anchored foundation system in accordance with the <br />following provisions: (P-ZNDED 9- 20 -88) <br />(1) over - the -tap ties be provided at each end of <br />the manufactured home, with one additional tie <br />per side at an intermediate location on <br />manufactured homes of less than fifty feet and <br />one additional tie per side for manufactured <br />homes of fifty feet or more; <br />5 <br />
