MOTION: <br />VOTE: <br />MOTION: <br />VOTE: <br />AGENDA ITEM J9: <br />Draft 1 -28 -91 Planning Board Minutes <br />access to the creek. Cameron stated that 60 <br />parkland dedication is required. Unless <br />Recreation and Parks decides that dedication will <br />not fit into the system, then payment -in -lieu of <br />dedication could be recommended. Due to the <br />lower number of lots, the amount required results <br />in a fairly small strip of land. <br />Eddleman moved approval as recommended by the <br />Planning Staff. Seconded by Hamilton. <br />Unanimous. <br />b. Preliminary Plans (20 Lots) <br />(1) Buck Run /Deed of Easement Acceptance <br />(20 Lots - Cheeks Township) <br />Presentation by Eddie Kirk. <br />On March 5, 1990 the Orange County Commissioners <br />approved the preliminary plan and Resolution of <br />Approval for Buck Run Subdivision. In this <br />resolution it was indicated that a deed would be <br />provided to Orange County for a public right -of- <br />way between lots 14 and 15 to allow future access <br />to property east of the subdivision. A 60' wide <br />deed of easement has been prepared and recorded <br />with the final plat. The County Attorney has <br />indicated this deed should be accepted by the <br />County in an amended Resolution of Approval. The <br />attached amended Resolution of Approval has been <br />approved by the County Attorney. <br />The neighboring property owner has indicated his <br />concern with the 60' wide right -of -way in that he <br />would like to connect a 50' wide right -of -way <br />when he develops his property. NCDOT has <br />indicated that a 50 foot right -of -way has been <br />connected to a 60 foot right -of -way in the past <br />and it would probably be acceptable in this <br />situation. They indicated they would have to see <br />development plans for the adjoining property <br />before approval could be given. <br />The Planning Staff recommends approval of the <br />amended Resolution of Approval. <br />Cantrell moved approval as recommended by the <br />Planning Staff.
