It should <br />include what is involved in getting your house on <br />the list and what the overlay district would <br />involve. <br />u� LJn��1 Collins stated that the purpose of this ordinance <br />is to create a committee to draft guidelines. <br />Jacobs asked if the Certificate of <br />Appropriateness had to be included as part of the <br />mechanism. <br />Collins stated it is enabling legislation. If <br />the Board wants to adopt the ordinance which <br />gives the Commission the power to utilize <br />Certificates of Appropriateness, then this should <br />be included in the ordinance. If the Board does <br />not want the Commission to have that power, it <br />should not be included in the ordinance. <br />Eddleman suggested to re -word Item 2 on Page 102, <br />Section 3.3 to state that for an individual piece <br />of land it is an election of the owner to <br />voluntarily enter into the agreement. <br />Cantrell commented that she knew of one situation <br />where a house was virtually inhabitable and the <br />owner was trying to make it a historic landmark <br />so that they would not have to upgrade the house. <br />Collins stated there are advantages in terms of <br />building code compliance. If a house is <br />designated as a historic landmark, either on the <br />local, state, or national level, certain building <br />code requirements can be waived. <br />Collins suggested to re -word Item 2, Section 3.3 <br />to read: No property shall be designated as a <br />landmark unless the property owner agrees to such <br />designation until the following steps have been <br />taken. <br />Collins stated that the commission's function <br />will be similar to that of the Planning Board. <br />They will make recommendations on areas to be <br />included in the Historic District. They cannot <br />do that until an inventory is done and they have <br />identified what the historical significance of <br />the site or area is. He stated that this is not <br />any different from the Planning Board doing a <br />land study of Efland and recommending that the <br />Board of Commissioners hold a public hearing on <br />it or make changes to the Land Use Plan or <br />Zoning Ordinance based on the study. The purpose <br />of this ordinance is to give the commission the <br />power to recommend but the final decision rests <br />with the Board of Commissioners.
