41 <br />9. Acquire by any lawful means the fee or any lesser included <br />interest, including options to purchase, to properties <br />within established districts or to any such properties <br />designated as landmarks; to hold, manage, preserve, restore <br />and -improve the same; and to exchange or dispose of the <br />property by public or private sale, lease or otherwise, <br />subject to covenants or other legally binding restrictions <br />which will secure appropriate rights of public access and <br />promote the preservation of the property. <br />10. Restore, preserve, and operate historic properties. <br />11. Negotiate at any time with the owner of a building, <br />structure, site, area or object for its acquisition or its <br />preservation, when such action is reasonably necessary or <br />appropriate. <br />Article 2. Historic Districts <br />section 2.1 Establishment of Historic Districts <br />Historic districts may be established as districts which <br />overlay other zoning districts as set forth in the Orange County <br />Zoning Ordinance. Upon the establishment of a historic district, <br />its boundaries shall be shown on the official Orange County <br />Zoning Atlas, and the use and development of any land or <br />structure within a historic district shall comply with use <br />regulations and dimensional requirements applicable to the <br />underlying zoning district. <br />Section 2.2 Procedure for Establishia Historic Districts <br />Historic districts, as provided for in this Section, may <br />from time to time be designated, amended or repealed; provided, <br />however, that no district shall be recommended for designation <br />unless it is deemed to be of special significance in terms of its <br />historical, prehistorical, architectural or cultural importance. <br />Such district must also possess integrity of design, setting, <br />workmanship, materials, feeling and /or association. No district <br />shall be designated, amended or repealed until the following <br />procedure has been carried out: <br />I. An investigation and report describing the significance of <br />the buildings, structures, features, sites or surroundings <br />included in any such proposed district, and a description of <br />the boundaries of such district has been prepared; and <br />2. The N.C. Department of Cultural Resources, acting through <br />the State Historic Preservation Officer or his or her <br />
